Abso-fucking-lutely stupid new anti-terrorism law

Post by Darth Wong »

http://www.todaystrucking.com/displayar ... fm?ID=2803

This is not the best article on the subject (that's in the newspaper), but the gist of it is that the FDA now wants all food shipments and shippers to be registered. This means that everyone shipping food anywhere in the US must register with the FDA and then individually register each and every single food-related parcel moving anywhere in the US.

The administrative overhead induced by this new law is insane; there are hundreds of thousands (roughly 400,000 at last count) companies which must register, tens of millions of parcels yearly at a bare minimum, and their parcel registration system did not come online until this morning even though everyone should supposedly be using it by now.

And what the fuck is the rationale of this "bio-terrorism" act? To stop bio-terrorism? Do they honestly think that if a terrorist wants to send anthrax somewhere, he will conveniently label it as a bio-product so that it will fall under their new bio-product shipping regulations? Gee, maybe a terrorist might not be particularly honest about what he's got in the parcel, did they think of that?

What a bunch of fucking idiots. Countless millions of dollars wasted on pointless paperwork in a totally useless effort to prevent "bioterrorism". This is obviously nothing more than a power grab by the FDA, which is estimated to need ten times more inspectors and much more funding in order to carry out the new agenda.

that's fucking stupid. . . .they're putting all of this money and effort to stop 'bioterrorism', in a compmletely idiotic way where they could actually put the effort into something that's actually useful and start cracking down on the real threat! like the grays invading the pentagon!

Isn't that unconstitutional if the transactions are made intrastate?

That's nothing compared to the worldwide mind-control system the USA is going to activate in the spring of 2004.

No, most likely this is well within commerce clause jurisprudence.

That's why I said "Intrastate". The Commerce Clause only governs shipments between states, not shipments inside the states.

There must be some limit on the distance of shipment which they will regulate. They probably aren't going to police a grocery chain trucking food from its warehouse three blocks over to the store. But it's still a gigantic power grab.

The guy on CNN who commented on it last night said that the FDA doesn't even have the authority to do uninvited inspections of food shippers' facilities, so it will have to GET EXPANDED POWERS from the federal government in order to carry out this new mandate. Small wonder the head of the FDA is gung ho about this law.

I don't think anybody cares about this one because it only impacts food shippers and importers, not the general public. It's backpage news, and besides, you can't criticize anything that says "anti-terrorism" on it or you must be a goddamned traitor, remember?

There was a nice poem about the slippery slope that is fascism I used to know...

At first they came for the Communists. I stayed silent.
Then they came for the Jews. I stayed silent.
Then they came for the infirm. I stayed silent.
Then they came for the Catholics. I stayed silent.
Then they came for me, and there was no one left to help me...

Well, with the economy not much of an issue anymore, the Democrats need something to use in 2004.

Well I guess this could end up creating jobs. Someone has to shuffle through all that paperwork.

Government jobs represent a net loss to both the government and the overall economy, all other factors being equal. Better these people were out shoveling shit for minimum wage, where they wouldn't be paid out of the U.S. Treasury and tax money wouldn't be taken out of the economy to support them.

As for intrastate commerce: there's a long precedent of applying the interstate commerce clause to anything that is part of an interstate supply chain. Unless the seed, fertilizer, pesticide, tractors, combines, shipping trucks, and final product all originated within the same state, and all their component materials originated in the same state, it falls under Federal jurisdiction. Don't blame me, blame SCOTUS for allowing Congress to use the commerce clause to justify every last thing they do.

They're looking in the wrong damn place for starters. If terrorists wanted to infect or poison masses of people in such a way they'd either use aerosols from crop dusting or other methods or contaminate water supplies. Food is very rarely an issue with modern packaging, the most recent types have labels that change colour if the package has been opened or an unknown agent is present.
