Kazaa offices raided (Sydney)

Investigators from the Australian record industry Friday raided a Sydney office housing the company that owns Kazaa, the world's largest file swapping network, in a bid to uncover evidence of alleged copyright infringements.

The Federal Court gave five major Australian record labels permission to raid 12 premises in three states to collect evidence against Kazaa, said Michael Speck, general manager of the Music Industry Piracy Investigations.

The group is owned by record companies Universal, Festival Mushroom Records, EMI Music, Sony Music, Warner Music Australia and BMG Australia.

The raided sites included the office of Kazaa owner Sharman Networks, the homes of two of the company's executives, three Australian universities and Internet service providers.

i mean seriously...


They aren't going to have any evidence on any of their servers... the only thing they can attempt to prove is try and find information that sharman encourage illegal music sharing, which they don't... they just can't control what people do with their software.

Isn't there also a legal waver that protects them in their TOA?

they must be going after IP logs to get the addy's of people who downloaded the software. Armed with that they can investigate individual file sharers.

Since when the hell are private corporations allowed to conduct raids in a search for evidence? Shouldn't the police do that?

I'll bet the fucking media companies are gonna try to justify this by saying something to the effect of "The Constitution only tells us what the GOVERNMENT can't do. We're a PRIVATELY-OWNED CORPORATION so we can piss all over illegal-search-and-seizure laws as much as we want!"

To that, I say: Who elected YOU to serve in a governmental capacity? Believe it or not, raiding someone's sovereign home is against the law without a warrant, no matter WHO wants to do it. Anything else is Burglary and/or Home Invasion, and the owners of the home have the right to SHOOT YOUR MOTHERFUCKING ASS DEAD THE MOMENT YOU STEP INSIDE! :finger:

EDIT: I don't know WTF an Anton Pilar order is, but shit like that won't fly here in America. Any 'copyright cartel gestapo' who attempts to raid my house will get a verbal warning to the effect of "Got a Warrant? Nope? Fuck you, You Cannot Come In!" followed by buckshot, bullets, and even blowgun darts if they force themselves in.

An Anton Piller order is basically an order from the court allowing a plaintiff in a court case to enter the premises of the defendant(s) and search for evidence which the defendant could conceivably want to hide/destroy. Fairly common in countries which follow the UK legal system AFAIK.


Edit: Oh, and it doesn't just apply to the "copyright cartel gestapo". The judge may give the order based on situational need - usually corporate fraud/embezzlement cases - where the order will be given to the Securities Exchange Commission or any anti-corruption agency or the like. If I'm not mistaken, Enron nd Arthur Anderson was the target of such an order.

I love living in Texas, MPAA comes to my door wanting to search my house I ask for a warrent, when they can't produce one I slam the door in their face a lock it. Should they attempt to bypass the door by means of force they are causing damage to my property and I now have the legal right to shoot them dead.
