Gay Marriage Amendment - Congressional Tally & News

Post by Joe »

Since I know that a lot of us will be wanting to follow this issue, I propose this thread be stickified so that we can track the development of this story without having to post a whole new thread everytime something happens. Sort of like the Breaking News thread on the Iraq war we had last year.

I will start with this tally from OxBlog of which Senators currently support and oppose the Amendment. If you want a whole bunch of links where you can read what the individual senators had to say about it, click on the above link for a list of them.

It's still painfully depressing that it's this close.

hopefully the cop-outs and undecideds will make up their mind soon. those against is beating those for only by a margin. . . .

Ok, forgive my newbie question, but what does a cop-out entail? :?

If more than it would take 5 of 6 being four just to get a tie. If less then 5 of those undecided show up, and no one votes against their statements, then this thing goes down in flames, and with all the focus it's brought to the issue, mabye we'll finally legalize gay marriage.

You need a 2/3 vote to pass such an amendment, right? So if the rest of the Senate votes in the same manner, such an amendment won't pass. And considering that one third are already voting against, unless some of the undecideds and cop-outs vote for an amendment, the listed senators opposed differently, or the vast majority of unlisted senators vote for an amendment, then the amendment won't pass.

I believe that they just need a majority in the senate and then have to have two thirds of states ratify it.

Are they talking about a constitutional amendment? Don't they need the states voting on that? And unanimous approval or such?

Nope. You need 2/3 of both the house and senate

Nope. You need 2/3 of both the house and senate
which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof
You actually DO need 3/4 of states- but that shouldn't be too hard once it gets past the National Legislature; I heard that about 38 states already have "defense of marriage" acts, so if it survives congress its probably gonna be law.

The amendment has already lost.
Tally it up. All you need is 2 more to vote against the amendment and that brings the opposition to 35. That is more than a third, and the amendment dies.

Update:
(68] Tom Harkin (D-IA): against
(69) Frank Lautenberg (D-NJ): against
(70) Charles Grassley (R-IA): cop-out
(71) Jeff Bingaman (D-NM): against
(72) Dianne Feinstein (D-CA): against
(73) Arlen Specter (R-PA): cop-out
(74) Max Baucus (D-MT): against
(75) Kent Conrad (D-ND): against
(76) Richard Lugar (R-IN): undecided
That brings the total to 39 against, only 28 for, 5 copouts, and 4 undecided. It looks like it isn't going to pass.

Even if every other senator voted for, with 38 against an amendment wouldn't pass.

Why'm I not surprised that Senators Robert C Byrd and Jay Rockefeller are among the 'Undecided'......?

Then again, Bobby Byrd always knows the way the wind's blowing, and when it's time to stay out of the storm.....

What a fucking surprise. Sen. Coleman owes his seat to Gee Dubya, he's never going to vote against something Bush is for. I'm surprised Mark Dayton hasn't weighed in yet, though.

Lieberman has come out against the amendment as well. He's one of the few Dems I might have expected to support it.
