Wow. I think that's overreacting a little... I mean, I remember making comments like that when I was in 3rd grade - did we bear any malignant intent with those comments? No, it was more of an observation. The kid shouldn't get away scot-free, but suspending him is too harsh.
It seems outrageous because it's just a kid, but if two adult males were standing around talking about a female coworker's breasts, they could potentially get in trouble. For better or worse, they're just applying a standard across the board.

True, but then again a ten year old kid isn't an adult and it's even money whether the kid even knew better. Punish him, perhaps. But going as far as to suspend him is more than a little overboard.

Legal precedent has been set in this case. Private E-mails circulating among male workers at one company regarding a female coworker's body somehow became known to the female in question, who promptly sued and won.

Really? Was it the emails that were considered harrassment, or the thought? I guess the 'everyone in the company is talking about YOU' factor is pretty important in this case. Harrassment is civil law, yes? So someone has to press charges?
