And people wonder at cons why I donate nearly $800-1000 dollars yearly to CBLDF.

Mostly because of stories like the topic header.

Freedom to shove your religion down everyone else3'sw throat. That's just one of the problems with the (idealologically sound) 1st Amendment.

Dalton, what was the book that you just finished reading? :)
Cryptonomicon by Neal Stephenson. Had a lot to do with WWII and present-day Phillippines. Places like Manila, Luzon, Corregidor...

One fucked up jury in a hyperactive dust bowl like Texas does not America make. We'll see how many times this gets smacked during the appeals process. The obscenity issue aside, this was a badly conducted trial if Mr. Castillo got convicted on the non-evidence detailed in the article. It'll probably make it to the US Supreme Court, just because no matter which side wins at each stage of the appeals process, the other will appeal to the next highest court.

All that being said, this is fucked up. A bunch of fucking Puritans out in East Cornhole, Texas, decided to try to ruin a man's life because he offended their religious sensitivities. I wonder, if you're religious, how that's not a sin, while selling dirty comic books to adults is.

EDIT: Just re-read the article and noticed how they didn't try to use the Miller test. If I recall correctly, it's necessary to use that test to determine obscenity in all cases, or else it's a First Amendment violation. Unless my ConLaw is off (no assurances that it isn't), that conviction should get thrown out as soon as it hits the first appeals court.

The porn is simply a side issue. A woman was mad because she thought he charged too much for Pokeman cards. Behold:
The article wrote:It all started in November of 1999, when a woman stormed out of Keith's Comics in Dallas, Texas, upset over the price of Pokemon cards. She threatened store manager Castillo, insisting that she could easily have the place shut down. "I know important people," she said. "All I have to do is tell them what you're selling here."
The porn is just an excuse for revenge.

I've always thought Pokeman was evil.

The First Amendment, Texas-style: Comic books remain dangerous into the 21st century

By Frank Beaton

Jesus Castillo, 31, is a convicted criminal. He's been sentenced to six months in prison, a $4,000 fine and one year of probation. His crime: Selling an adult comic book to - wait for it - an adult.
To quote Artemis Radio when they reported on this last December.... "Texas... Goddamn *Bleeeeeeeeeeeeeeeep*'s. REFUSE!"

Of course, this is the South, where sodomy is illegal in many states, even among two consenting adults. I'm sure the case will be thrown out, and if we're lucky, the woman will be deemed insane.

Apparently, my ConLaw is off. Mine or the appeals justices. Let's see if SCOTUS tolerates this nonsense...
