That was a thing in the german case actually. In the initial trial court, the defense argued successfully that consent freely given should drop the charge to manslaughter rather than murder. The prosecution successfully appealed that part...

It takes more than one person to launch a nuclear weapon, and the people who are involved are repeatedly vetted and checked. It's not just "you pass, you're in, we'll trust you forever." It's more like anything else with a Top Secret clearance; you never have full privacy again because the state has a permanent interest in making sure you're psychologically stable, your finances are in order, and so on.
