By the time the cops were actually able to get to him (which required multiple explosive charges placed by the SWAT team), he was no longer a threat; the killdozer had broken down by then. He wasn't going anywhere. If the police had killed him as soon as they'd gotten the dozer open, it would have been excessive force because he no longer posed a threat.
What, we can't laugh at the situation and have fun with it? Nobody was hurt. That's what's important. If someone had been killed, it would be completely different, but that's not the case. It's not like we're saying "people should do this", we're just taking advantage of this opportunity to be able to have a laugh at the insanity that humanity can produce. Besides, if they were smart, they'd call him a terrorist and get excessive amounts of cash out of the Feds like the people associated with the WTC did.
