In practice it wouldn't happen that way. The House can charge with a simple majority, but the Senate needs a 2/3 supermajority to convict, which barring an impossible landslide in multiple consecutive election cycles (because only a third of Senators are up for reelection in any given year) isn't going to happen on a partisan basis. In any realistic scenario there needs to be an actual crime there for conviction and removal. (Note that removal from office is the only penalty the Senate can exact; if a crime warrants further punishment it has to go through the courts.)
