i've been there before. the club is way too small for pyrotechnics..and get this, THEY DIDN'T HAVE A FUCKING PERMIT!. The death toll is up to 60 with over 2 dozen more in intensive care at the burn centers at Rhode Island hospital and Mass. General......there is a lot of blood on someone's hands

Great White's road manager should have had the fucking common sense to know that the goddamn place was too fucking small. If he's the same one they had ten years ago, and bands are loyal enough to stick with the same guy, he's an idiot and an asshole, I've met him.

I think some people need a crash course in tort law. In order to show a tort, you must show that:
1) The defendant had a duty of care
2) The defendant breached that duty
3) Material losses were sustained
#3 is easy in this case. It's #1 and #2 which will be tricky. The band, being totally ignorant of these things, would bear no responsibility. The responsibility would fall upon the party who "should have known better". The band's stupidity and ignorance of all things technical would shield them from liability (yes, I know, it sounds perverse, but that's how it works).

Maybe. At the very least they probably said "Hey! This would be cool!" And the manager didn't have the balls to tell them 'no'. However, the band isn't likely to think about or realize all the safety concerns, while the manager and the Club should have. So far, the band is claiming the club manager gave them permission to use pyrotechnics, while the club owner is claiming nobody said anything to any of his people about pyros, and if someone had, the manager would have said no because the club isn't liscensed. In another twist that makes Great White look very, very bad right now, a club owner in Asbury Park, New Jersey where the band played last week also claims Great White used stage pyrotechnics without asking or even informing club management.
Wong, this will be more than just a lawsuit. If somebody set of pyros in an unliscensed club that didn't even have a sprinkler system, it's 85+ counts of negligent homicide on somebody's part. It comes down to whether or not the club knew Great White planned to use them. If they did, it's on the owner and manager of the club. If they didn't, it's on the stage manager of Great White.

Under Rhode Island law, public buildings with less than a specified area and less than a certain maximum capacity don't need sprinkler systems. This was a really small club, with a maximum occupancy of only around 300 people. From everything I've heard so far, the club owner was pretty careful about following all the rules (he's a respected local businessman, not like the schmoe running the club in Chicago).
