A federal judge in Georgia fined a leader of the movement challenging President Barack Obama's citizenship and warned her against using the legal system to pursue "political rhetoric and insults."

U.S. District Judge Clay D. Land's scathing 43-page order Tuesday said California lawyer and dentist Orly Taitz filed "frivolous" litigation and attempted to misuse the federal courts to push a political agenda.

Taitz, a leader of the so-called birther movement, sued in Georgia federal court on behalf of Army Capt. Connie Rhodes. Rhodes sought to avoid deployment to Iraq by claiming Obama wasn't born in the U.S. and that he was "an illegal usurper, unlawful pretender and unqualified impostor."

Documents show the president was born in Hawaii.

Land, appointed in 2001 by President George W. Bush, had already dismissed the lawsuit, but Taitz continued filing motions. He said he fined her $20,000 "as a deterrent to prevent future misconduct and to protect the integrity of the court."

"The absolute absence of any legitimate legal argument, combined with the political diatribe in her motions, demonstrates that Ms. Taitz's purpose is to advance a political agenda and not to pursue a legitimate legal cause of action," Land wrote.

He added that while Taitz's speech is protected by the First Amendment, "the federal courts are reserved for hearing genuine legal disputes, not as a platform for political rhetoric and insults."

Taitz told The Daily Report that Land's order is "an absolute outrage."

"All I can say is that this order is issued with a goal to intimidate me, harass me and retaliate against me for bringing a legitimate action on behalf of my client," she said.

I didn't see this posted yet. It made my day. I've seen on other sites that she claims she isn't going to pay either.

That is nothing. The judge in Kitzmiller v. Dover Area School District was appointed by Bush. For some reason judges tend to shift leftward when put into power. Or Bush didn't have enough dittoheads to pack the judiciary with and most of the lower levels got reasonably decent justices.

The latter seems more likely than the former. There's no reason why someone would "shift leftward" after getting a job. It seems more likely that the right-wingers simply have no legal leg to stand on in these cases and the judges are trying to do their jobs properly.

The judgement slapping her with the fine has to be read to be believed. She demanded the judge recuse himself because (amongst other things):-

* She tendered an affidavit from some guy that he had seen The Attorney General of the USA in a coffee shop in Columbush, the implication (made up out of thin air) being that the judge had an 'improper' discussion with said AG about the case;

* He had a conflict of interest in the outcome of the case (which was about a soldier refusing to go to Iraq - that soldier having since fired Taitz) - because he had shares in Microsoft and Comcast.

A few months ago, a member of the California bar sent the bar association a letter demanding she be disbarred for bringing the state bar into disrepute. It better happen.

What always surprises me is that people so dumb can get jobs as lawyers or doctors or scientists. However it is that this process works, it's quite unfortunate because it lends an air of legitimacy to their arguments via appeal to authority. If only we taught fallacies in school, politics would be so much... neater.

I am reading through decision and I cannot help but quote this judge

There are so many jumps in logic in her theories that they make 9/11 conspiracy nuts look competent in comparison! First Obama's mother has to be a prophet to know that she needs to make sure that her new son will need a Hawaii birth certificate because he'll be president in the future. Second, they then have to trick 2 papers to print the birth announcement. Edit: Third, they then have to make and place a so obvious fake real certificate, that only shows up after she starts her crusade, into the real birth papers in Kenya that when it surfaces no one will believe it's real.

How would one even pull something like this off? If they did phone in the birth info like she claim they did, it wouldn't have been printed in the paper because unless the papers go through all the paperwork at city hall every day they won't have been given notice of it.

Shes a Doctor, most medical officers live in a neat little world of hospital seclusion where they are no more responsible for soldiers/sailors/airmen/Marines than the average surgeon is responsible for the nurses in their field at a hospital. So yeah she may be resented but not widely enough and most medics and nurses are professional enough to let Doctors who are good specialists but shitty leaders do what they are good at before pushing them out of the way.
