It's an executive order. Bush can rescind it at will. And CNN has merely indicated that he's considered it not that he "tried" to do so. That wouldn't make sence.

The order, at this point, is pointless. We're never going to formally declare war on another nation again thanks to the War Power Act and the little informal truce the Executive and Legislative Branches have formed over it, so that would make it a little difficult to assassinate the head of state of a nation we're "engaged in military aggression against."

Its irrelevant. We are at war, and during war the leader of a country is a legitimate military target. Killing said leader is an act of war and fully within the rights of the beligerents.
