1 year ago today Henry McCollum and Leon Brown were exonerated when it was proved that Roscoe Artis (who would be convicted of a disturbingly identical crime committed a month later and is suspected in the death of another woman 3 years ago in similar circumstances) was the one who raped and strangled Sabrina Buie. Now the state finally seems to be giving these men compensation.

All I can say is that its about time. Of course the prosecutor and detectives still refuse to admit they screwed up.

I'd be more happy if they could sue the police and prosecutor. The actual killer lived 100 feet from where the body was found, was convicted of a similar murder that occurred a month later, and had a history of sexual violence dating from 1957. The confessions were inconsistent and the bits that did add up were most likely fed to them (one of the agents at mccollum's confession was at the autopsy the day before). Three days before the trial the police asked the prosecutor to compare some unknown prints found on a can that hand the prints of Buie but neither McCollum nor Brown against Roscoe Artis and Leonard Sinclair (who had given a jailhouse snitch testimony but whom admitted to lying and whose admission was supported by the results of a polygraph). The tests were never done and the requests weren't turned over to the defense.

Of course the prosecutor and one of the lead investigators still refuse to admit the mistake. The prosecutor (who initially emphasized the importance of the cigarettes when he thought they proved mccollum's guilt) tried to downplay it when the dna implicated artis. Considering that the prosecutor has gotten more death penalty sentences than any other prosecutor (though only two have been carried out) it raises disturbing questions.

Even worse is that McCollum came to see Artis as a father figure and was devastated when he learned that Artis was the one who carried out the crime. His mother died one year before his release and so did the grandmother that raised him.

And funnily Scalia cited this case as why the death penalty is just. Whatd'ya say now Antonin?
